Lee Trollinger was killed when he was struck in the rear by a tractor-trailer operated by an employee of Dot Transportation. His car burst into flames as a result of the impact.

The decedent left a wife and two sons from a previous marriage. His youngest son is autistic. The issues in this case were the decedent’s loss of future earning capacity and solace damages for the current wife, autistic son and older son.

The evidence would have shown that his older son had just begun reestablishing a relationship with decedent after years of estrangement. The defense contested the extent and sufficiency of future wage loss, given the decedent’s employment history.

It also contested the nature and extent of the contacts and relationship between the decedent and his two sons and the capacity of his autistic son to feel and understand the loss.
